9.04.020 Kittery Firearms-Unlawful discharge.
A. It is unlawful to discharge or intend to discharge within certain areas of the town as set forth in subsection B of this section any firearm, rifle, shotgun, automatic rifle, revolver, pistol, machine gun, or any other weapon designed for the purpose of firing or discharging a shell or other weapons designed for the purpose of firing or discharging a shell or cartridge, whether such shell or cartridge is blank or live ammunition.
If any person or persons are in the no shooting area (as defined in subsection (B)(1) of this section) with a loaded firearm, this shall be prima facie evidence of the intent to discharge a firearm in the no shooting area.
Exception to this subsection will be any person who holds a valid permit to carry concealed firearms under 25 M.R.S.A. § 2003.
B. Paragraph A of this section shall apply to:
1. An area within the town starting at the Piscataqua Bridge on Route 95 to Haley Road, then south- southeast along Haley Road to Hoyts Island Lane; thence turning and proceeding along the shore of the Piscataqua River to the starting point at the Piscataqua Bridge and the waters of Spruce Creek;
2. All other land in the town, except hunting with a shotgun or smooth bore muzzle loader in the state of Maine open hunting season on migratory bird, upland game and deer.
C. This section shall not apply to:
1. The area bordered on the West by Route #1, on the South by C.M.P. power line right-of-way east to Norton Road, north along Norton Road to Miller Road, east to Bartlett Road, north on Bartlett Road to Payne Road;
2. Law enforcement officers acting in the' performance of their duties;
3. Shooting ranges which are operated or under the supervision of the Kittery police department, or which are privately operated and approved by the Kittery chief of police or his/her designee;
4. The use of blank cartridges for a show of theatrical production or any supervised educational program, for signal or ceremonial purposes in athletic or sports events, or by military organizations or service groups;
5. Self defense or excusable homicide situations;
6. Testing by a professional gunsmith into a suitable container, backstop or target as approved by the Kittery police chief or his/her designee;
D. Any violation of this section shall constitute a civil violation punishable by a fine not exceeding fifty dollars ($50.00). (Ord. 3-88: Ord. 1-88: prior code § 8-5)
